General terms and conditions of

V.O.F. Kiosk Koppers.

All amounts mentioned in these terms and conditions include sales tax.

In these terms and conditions, the following definitions shall apply:

  • The lessor:
    V.O.F. Kiosk Koppers entering into an agreement concerning the provision of a vessel for a fee.

  • The hirer:
    The natural or legal person who enters into an agreement regarding the use of a vessel for payment.

  • The rental agreement
    : the agreement by which the lessor undertakes to give the lessee the use of a vessel without crew for a fee.

The agreement

  • The agreement is established by acceptance and payment of the offer by the lessee.
  • In case of electronic assignment, the landlord sends an electronic confirmation to the tenant.
  • All provisions naming the lessee shall apply mutatis mutandis to any co-passengers or third parties using the boat under the lessee’s approval. (By the way, the lessee may not surrender the vessel for use without written permission from the lessor).
  • The renter is responsible to fellow passengers and previously mentioned third parties regarding compliance with the terms and conditions. Failure to do so will be attributed to the tenant.
  • By reservation, a binding rental agreement of rent is established between the parties.
  • The lessor, in this case the partners of V.O.F. Kiosk Koppers, are assisted in the conduct of business by the employees who are therefore entitled to act on, among other things, compliance with the general conditions.

The prize

  • The rental price and any additional charges to be paid by the tenant will be agreed upon in advance, as well as any authority for interim price changes.

Boat rental period

  • If the agreed time of arrival is exceeded, an additional amount of money will be charged in accordance with the then current rental rates. This amount is due and payable immediately without any demand or other notice.
  • The reserved boat must be picked up by the renter no later than the time indicated on the booking. Late arrival by the renter to pick up the boat, for any reason, means shortening of the rental period and does not entitle the renter to a refund or (possibly part) of the rental fee.
  • In other words, later actual departure does not affect the agreed return time, does not result in a reduction of the agreed rental amount and therefore does not entitle you to postpone the agreed return time.
  • In case of later arrival, more than 15 minutes after the agreed starting time without notice, the lessor reserves the right to cancel the reservation without refunding the rental fee and the lessor is entitled to re-rent the reserved boat.
  • Landlord is not liable for failure of the boat reserved by tenant to arrive on time. If it does not return on time, then another type of boat with a possible different rental price can be chosen in consultation with the rental company, or you can wait and choose another rental period by mutual agreement.
  • In case of a breakdown, the lessor must be notified immediately, possibly by telephone, giving boat number and nature of the breakdown, so that the damage can be repaired. Refund of the rental fee will not take place in case of breakdown.


  • The deposit is €100 per boat or otherwise as determined by the lessor.
  • Tenant will receive a receipt from landlord showing the deposit amount due, which must be handed to landlord upon return.
  • By presenting the above proof, the deposit will be refunded or not, possibly partially or completely.
  • Any excess rent will be deducted from the deposit in addition to any additional payment.
  • If the rules are violated and in case of damage caused to third parties, the landlord is authorized to terminate the rental early without returning the rental fee and/or deposit.

Payment terms

  • Booking through the website must be paid in advance by bank.
  • The renter must pay the agreed payments as a deposit, and/or the costs for any agreed change in the rental period and/or boat type, by cash before departure.
  • Any additional payments or refunds will be settled by cash.
  • Damage and/or repairs charged by landlord must be paid by cash, and/or settlement through the deposit and/or within 2 weeks by bank.


  • In case of bad weather, it is possible to change the reservation to an indoor canal cruise on payment of any additional price, any lesser price will not be charged.
  • Cancellations of the rental agreement must be reported to the landlord in writing or by email.
  • In case of cancellation, the booking fee of € 10,=, whether or not already mentioned in the booking, will be forfeited to the landlord. If these booking fees are not listed separately at the time of booking, they are considered to be included in the rental price.
  • In case of early termination of the rental by the lessor immediately after sailing due to not having sufficient control of the helmsmanship, the lessee will owe a compensation of at least € 10,= and the rental time already used up.
  • In addition to the booking fee due, an indemnity of:
  • 0 % of the rent excl. the booking fee up to 1 week before the start of the rental period.
  • 50% of the rent excl. the booking fee up to 2 days before rental startperiod .
  • 100% of the rental price excluding the booking fee within 2 days before the start of the rental period.

Landlord’s obligation

  • At the start of the rental period, the lessor shall provide the boat to the lessee in good condition.
  • The lessor shall provide clear instruction to the lessee on the operation of the boat.
  • The landlord hands the tenant a boating route map and explains it.
  • The lessor undertakes to insure the vessel against legal liability.

Tenant’s obligation

  • The renter or one of their fellow passengers must be in good control of the boat as driver. If this is not the case, possibly also at the request of the lessor, someone more proficient in the art of sailing should take the helm. If, in the opinion of the lessor, the driver’s steering skills are insufficient, the lessor is authorized to still terminate the rental early. The minimum age of the driver of the boat must be 16 years old.
  • The hirer shall acquaint himself well in advance with the sailing route map and/or sailing route instruction provided by the lessor and take it with him on the cruise.
  • The lessee shall approve the condition of the vessel before sailing, also the lessee shall check the vessel for the presence of a boating boom. If the lessee leaves without reporting any damage and/or defects, the vessel, including accessories, is deemed to be in good condition.
  • The lessee shall use the vessel as a good steward and good skipper and in accordance with its intended use.
  • The lessee may not surrender the vessel for use without written permission from the lessor. Subletting or so-called lending of a rental boat is not allowed.
  • The renter agrees to return the boat to the place of receipt on time within the predetermined rental period, with all accessories and in condition as received.
  • The renter agrees not to exceed the maximum number of persons per boat as indicated by the boat type during boating.
  • If damage is noticed by the Tenant of any kind and/or circumstances that could reasonably lead to damage or if damage is caused by the Tenant, the Tenant must notify the Landlord as soon as possible.
  • The lessee shall comply with the lessor’s instructions for the preservation of the vessel and for the preservation of the lessor’s rights.
  • In case of a breakdown, the rental company must be informed immediately, possibly by telephone, giving the boat number and nature of the breakdown, so that the damage can be repaired. Refund of the rental fee will not take place in case of breakdown.
  • The renter is obliged to comply with the rules of the game and the traffic rules on the water as described, among other things, below in these general conditions.
  • The renter is responsible for fellow passengers also with respect to compliance with all rules and game rules stated in these general conditions. Non-compliance by fellow passengers will be attributed to the renter. All provisions mentioning tenant apply mutatis mutandis to all co-passengers.


  • The lessee is liable for damage, consequential damage and/or loss of the vessel incl. accessories, to the extent not covered by insurance, arising during the tenant’s time in possession of the vessel.
  • The lessor assumes no liability for damages resulting from death, injury, accidents, injury, destruction, loss or theft caused during or as a result of the boat rental or by collisions.
  • The Lessee shall indemnify the Lessor against all damages of third parties and fellow passengers, for which the Lessor might be liable under the law and for which the Lessor’s third-party insurance might not provide coverage.
  • The lessee indemnifies the lessor against all damages to boats, accessories and/or other claims for damages from fellow passengers and/or third parties, for example ( but not limited to), damages resulting from fines, violations, misdemeanors, loss and/or loss.
  • The Lessee indemnifies the Lessor against all fines, administrative sanctions, transactions, etc. that may be imposed on the Lessor for crimes or violations committed during the rental period by the Lessee and/or driver and/or passengers.
  • The hirer is liable for damages and costs, which are not insured through the third-party insurance, resulting from not following the instructions given by the lessor to preserve the vessel and to preserve the rights of the lessor.
  • The lessor is not liable for material and/or physical injury to the lessee and his fellow passengers also caused by, among other things (but not exclusively) negligence, vandalism, wantonness, alcohol consumption etc. etc., e.g. hands and fingers between the boats and shoring, falling when getting in and out of the boat, slipping in the boat, diving into shallow water etc.
  • The renter must take care of any rescue equipment such as. life jackets for himself as well as for fellow passengers. Landlord is not liable for accidents resulting from failure to master the art of swimming.
  • The lessee is liable for damage caused to boats and/or accessories belonging to the lessor.
  • The liability and indemnity limitations do not apply in case of intentional or deliberate recklessness of the Lessor or its executive subordinate(s).

Rules of the game on the water

  • Bringing and consuming alcoholic beverages is not permitted.
  • Diving from the boat is not allowed, the water around Giethoorn is very shallow in most places.
  • While swimming in the water, it is forbidden to be towed by a boat, with or without a rope, for example.
  • Hands, fingers and all limbs, while in the boat, should be kept inside the boat, that way they won’t get between anything.
  • Towing or pushing other vessels is not permitted.
  • The compartment containing the batteries must not be opened and/or used to store personal items.
  • In case of breakdown, the lessor should be notified immediately, by telephone if necessary, giving boat number and nature of the breakdown, so that the damage can be repaired.
  • It is recommended to use swimming shoes or something similar while swimming to prevent injuries to feet and legs, among others, due to the presence of such things as trash, branches, mussels, shells, etc. on the bottom of the swimming location.
  • It is forbidden to sit on the protective bracket of the outboard motor as well as on the engine.
  • The driver of the boat should sit alone and not with more than one person on the skipper’s bench to drive the boat. On boats with a steering wheel such as console boats and electric sloops, the driver should sit alone and centrally behind the steering console, i.e. with feet to the left and right of the console . This driver must then simultaneously operate both the steering wheel and the throttle lever.
  • In case of dirt in the propeller of the engine, it should be removed by the driver himself, to do this, first disconnect the power supply cable to the batteries and/or remove the ignition key from the ignition switch.

Traffic rules on the water.

  • The renter is bound by the applicable traffic regulations on water.
  • The maximum boating speed in the old core of Giethoorn is 6 km/h.
  • The minimum age to drive a motor vessel is 16 years old.
  • Between post 1 and post 5 in the village canal is one-way traffic.
  • The lessee should reduce speed when approaching busy locations and intersections especially also in the village canal and the shipping channel ‘Beukers-Steenwijk’.
  • Traffic in the village canal has priority over the side canals.
  • Tour boats and sailboats always and everywhere have the right of way, even if they make a special maneuver such as reversing and turning.

Other provisions

  • In case of violation, and also in case of suspicion of violation possibly in the future, of the rules described in these general terms and conditions, the lessor as well as the employees employed by him, whether or not in function as a canal skipper en route on a boat, and also the competent authority is entitled to unilaterally terminate the rental, at any time even before the start of the boat trip, without refunding the rental fee and / or deposit.

Choice of law

  • This agreement and all disputes are governed exclusively by Dutch law.
